These Terms of Service (“Terms”) govern your use of vivna.net (the “Site”) and the insurance quoting, enrollment, and customer service provided by Vivna Inc., doing business as Vivna Insurance (“Vivna,” “we,” “us,” or “our”). By using the Site, requesting a quote, or communicating with a Vivna agent, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or our services.

About Vivna

Vivna Insurance is a licensed independent health insurance brokerage headquartered at 1353 SW 26th Ave, Deerfield Beach, FL 33442. We are licensed to sell health, dental, vision, and supplemental insurance in the states where we operate. We are not an insurance company. Every policy we sell is issued and underwritten by the insurance carrier or third-party administrator named on the policy. Vivna earns commissions from carriers on the policies we place.

Our Services

Vivna helps you compare, select, and enroll in insurance plans from the carriers we represent. Our services include quotes, plan comparisons, application assistance, and ongoing customer service for policies placed through Vivna.

• Quotes are estimates. Final premiums, benefits, and eligibility are determined by the carrier when your application is approved.
• Coverage begins only on the effective date stated by the carrier after the carrier approves your application and receives your first payment. Submitting an application through Vivna does not create coverage.
• Not every plan is available in every state, and plan availability, rates, and benefits change without notice.
• Vivna does not represent every carrier in the market. We recommend plans from the carriers we are appointed with based on the information you provide.
• Claims are handled by your carrier. Vivna does not process, adjudicate, or have access to claims.

Eligibility

You must be at least 18 years old and a resident of the United States to request a quote or apply for coverage through Vivna. A parent or legal guardian may provide information about a minor solely to add that minor as a dependent.

Your Information and Responsibilities

You agree to provide accurate, current, and complete information when requesting a quote or applying for coverage, including dates of birth, household size, income estimates, tobacco use, and health questions required by the carrier. Inaccurate or incomplete information can result in incorrect quotes, denied applications, or a carrier rescinding coverage. You are responsible for reviewing your application before it is submitted and for reading the policy documents the carrier provides.

You are also responsible for keeping any login credentials for carrier or Marketplace accounts confidential, for paying your premiums directly to the carrier on time, and for notifying us or the carrier of changes in address, dependents, or eligibility.

Consent to Contact

When you request a quote from Vivna, from one of our marketing partners, or by calling us, you expressly consent to receive calls and text messages from Vivna and its licensed agents at the phone number you provided, including calls and texts placed using automated dialing technology and prerecorded or artificial voice messages, regarding insurance products and services. Consent is not a condition of purchasing any product. Message and data rates may apply.

Calls with Vivna may be monitored and recorded for quality, training, and compliance purposes, and our agents disclose this at the start of each call. By continuing a call after that disclosure you consent to recording.

You may revoke consent to be called at any time by telling an agent, emailing memberservices@vivna.net, or calling 888-730-6001. We honor internal Do Not Call requests within 24 hours and the National Do Not Call Registry. Our written Do Not Call Policy is available on request.

SMS Terms of Service

By opting in to text messages from Vivna Insurance, you agree to receive appointment and callback reminders, quote and enrollment updates, and customer service messages from Vivna Insurance. Message and data rates may apply. Message frequency varies. Text HELP for help. Text STOP to cancel.

You can cancel this service at any time by texting STOP. After you send STOP, we will send one reply message confirming you have been unsubscribed, and you will no longer receive messages from us. If you want to join again, opt in the same way you did the first time and we will start sending messages to you again.

If at any time you forget what keywords are supported, text HELP. After you send HELP, we will respond with instructions on how to use our service and how to unsubscribe.

Carriers are not liable for delayed or undelivered messages.

Email Communications

By providing your email address you agree to receive email from Vivna about your quote, application, and policy, and about coverage options and enrollment periods. Every marketing email includes an unsubscribe link. Unsubscribing does not stop transactional messages about a policy you hold, such as document delivery or billing notices from your carrier.

Insurance Carriers and Third Parties

The insurance carriers, third-party administrators, and the Health Insurance Marketplace are independent of Vivna. Their policy terms, rates, provider networks, billing, and claims decisions are their own. The Site links to carrier websites, provider directories, and quoting tools operated by those parties; your use of those sites is governed by their terms and privacy policies. Vivna is not responsible for the content, availability, or practices of third-party sites.

Intellectual Property

The Site and its content, including text, graphics, logos, page layouts, and blog articles, are owned by Vivna Inc. or used under license and are protected by copyright and trademark law. Carrier names and logos belong to their respective owners and appear on the Site to identify the products we offer. You may view and print pages for your personal, non-commercial use. You may not copy, republish, scrape, or redistribute Site content without our written permission.

Prohibited Uses

• Submitting false information or requesting quotes on behalf of someone without their authorization
• Using the Site or our services for any unlawful purpose or in violation of these Terms
• Using bots, scrapers, or automated tools to access or extract Site content or submit forms
• Attempting to interfere with the Site’s security or operation
• Impersonating Vivna, an agent, or a carrier

Disclaimers

Information on the Site, including blog articles, plan descriptions, and FAQ content, is general educational information and is not a policy, a contract, or a guarantee of coverage. It is not medical, legal, tax, or financial advice. Benefit details, exclusions, and limitations are stated in the policy documents issued by your carrier, which control in the event of any conflict with the Site.

The Site and our services are provided “as is” and “as available.” To the fullest extent permitted by law, Vivna disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the Site will be error-free or uninterrupted.

Limitation of Liability

To the fullest extent permitted by law, Vivna Inc., its officers, agents, and employees will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits or lost coverage, arising from your use of the Site or our services, from any carrier’s decision regarding your application, coverage, or claim, or from any third-party site. Vivna’s total liability for any claim relating to the Site or our services will not exceed one hundred dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law, including obligations we owe you under state insurance regulations.

Indemnification

You agree to indemnify and hold harmless Vivna Inc. and its officers, agents, and employees from any claims, losses, or expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of the Site, or inaccurate information you provide in connection with a quote or application.

Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Broward County, Florida, and you consent to the jurisdiction of those courts. Before filing any claim, you agree to contact us at the address below and give us thirty (30) days to resolve the issue informally. Nothing in this section affects your right to file a complaint with your state’s department of insurance.

Changes to These Terms

We may update these Terms when laws, our services, or our practices change. The current version is always posted on this page with the “Last updated” date. Continued use of the Site or our services after an update means you accept the revised Terms. We may also suspend or discontinue any part of the Site at any time.
